What Is Cruise Ship Illness or Accident Compensation?

A cruise ship illness or accident claim is a way to seek compensation if someone else’s negligence caused your illness or injury while on board.

Boarding the cruise ship for your holiday is an exciting time. The last thing you’re thinking about is what to do if you fall ill or have an accident.

Once you board the cruise ship, the cruise line company is legally obliged to ensure all necessary steps are taken to keep every passenger safe and healthy. Failure to do this, resulting in you falling ill or having an accident, is grounds for a claim.

If you believe your accident or illness was a result of the cruise line’s negligence or the negligence of another passenger on board, you may be entitled to compensation.

Should it be proven during the claim process that another person is at fault, then you could receive a lump sum compensation amount.

How Long Do You Have to Make a Cruise Ship Claim?

You generally have two years from the date you disembarked your cruise to make a claim. Cruise ship claims in England and Wales are governed by the Athens Convention 1974, an international treaty that sets out the rights of passengers and the liability of cruise operators for injury, illness, and loss.

Some package holiday deals in the UK may allow for a longer limit of three years. If a child falls ill or is injured, the time limit may also be extended.

Time limits can vary depending on how the cruise was booked and where the cruise line is based, so it’s important to act quickly. Speaking to our team as soon as possible gives you the best chance of success.

Types of Cruise Ship Illness and Accident Claims

Passengers can make claims for a range of situations, including:

Illness on board:

Food poisoning, allergic reactions, or viral outbreaks caused by poor hygiene or unsafe food preparation may form the basis of a claim.

Accidents on board:

Slips, trips, falls, or injuries caused by wet floors, faulty equipment, or unsafe conditions can lead to compensation claims.

Embarkation and disembarkation injuries:

Accidents while boarding or leaving the ship, including falls on gangways or uneven surfaces, may be the cruise line’s responsibility.

Overboard or extreme weather incidents:

If poor safety procedures or inadequate precautions contributed to an injury during bad weather, you may be able to claim.

Excursion-related injuries:

If you were injured during an excursion arranged by the cruise line, the company may still be liable.

Frequently Asked Questions

Your questions, answered.

You can claim compensation for a severe inconvenience caused by injury or illness while on a cruise. If you get food poisoning, the flu, or experience severe delays or cancellations to port dockings, then you may be able to seek financial compensation from a cruise ship claim.

Yes, travel insurance often covers a cancelled cruise. However, it’s important to check your insurance documents for under what circumstances this applies. For example, voluntary cancellations often aren’t included, but you may be covered for cancellation due to illness or personal injury.

If the cruise liner company cancels your cruise, then you will likely be entitled to a full refund or be able to re-book on an alternative cruise. Should the cancellation happen at the last minute, and you’ve already travelled to your boarding destination, you may also receive money for food, drinks, or overnight accommodation.

The amount of compensation you could receive depends on the nature and severity of your illness or injury. Experts use the Judicial College Guidelines (JCG) to help calculate awards, with figures varying widely based on the type of claim. You can also use our handy Personal Injury Calculator.
As a general guide:

  • Minor injuries such as short-term food poisoning or soft tissue injuries typically fall in the lower range, often between £1,000 and £5,000
  • Moderate injuries requiring ongoing treatment, such as a broken bone or prolonged illness, may attract awards between £5,000 and £30,000
  • Severe or life-changing injuries, including those with long-term physical or psychological effects, can result in significantly higher awards

Your final settlement will also take into account any financial losses, such as medical costs, lost earnings, or travel expenses incurred as a result of your illness or injury.

No-win, no-fee” means you won’t pay us anything unless we win your case.

There are no upfront costs and no hidden charges. If your claim is unsuccessful, you won’t owe us a penny. If we win, our fees will be taken from the compensation we recover for you — and we’ll explain all of this clearly before you sign anything.

It’s a simple promise: if you don’t win, you don’t pay.

Yes, you can still claim compensation if you believe you were partly responsible for the illness or accident.

However, this will be reflected in the amount agreed on for the settlement. Typically, you’ll receive less compensation for illness or accidents that you were partly to blame for, but you may still be able to recover a portion of the losses.

Yes. If you were injured in an accident on board a cruise ship, during embarkation or disembarkation, or on an excursion arranged by the cruise line, you may be entitled to claim compensation.

Cruise lines have a legal duty of care towards all passengers. If your accident was caused by their negligence, whether that’s a wet floor with no warning sign, faulty equipment, or poor safety procedures, you have the right to seek compensation for your injuries and any financial losses that followed.

The same no-win, no-fee process applies to accident claims as to illness claims. Get in touch with our team, and we’ll let you know if you have a case.

As well as this type of claim, we also handle cosmetic surgery and facelift claims, cruise ship illness and accident claims, accident abroad claims, and medical negligence claims. If you’re not sure whether your situation qualifies, get in touch and we’ll let you know.
