When Mark purchased his dream home in Runcorn, he expected a smooth transition and the chance to enjoy summer in his new garden. But a persistent odour led him to investigate, uncovering a hidden and non-compliant septic tank that breached multiple environmental regulations.
What Went Wrong
The seller of the Runcorn property had correctly disclosed that a private septic tank served the home. However, Mark’s conveyancing solicitors failed to investigate this further, mistakenly assuming the house was connected to the public sewer system, and raising no concerns before completion.
As a result, Mark went ahead with the purchase, unaware that the septic tank system did not comply with the General Binding Rules 2015 – environmental regulations that require private drainage systems to be safe, properly maintained, and not pollute local water sources.
When Mark eventually discovered the old septic tank hidden beneath the decking, he tried to manage the problem himself. He spent thousands of pounds regularly pumping the septic tank to control the stench. While the water would briefly subside, the foul odour always returned.
Hoping to enjoy summers in the garden, including hosting his son’s wedding party, Mark’s plans were repeatedly delayed, and the ongoing disruption left him frustrated and burdened with unnecessary expenses.
Contacting CEL Solicitors
After many unsuccessful attempts to manage the issue himself, Mark contacted CEL Solicitors, specialists in septic tank negligence claims. We identified the conveyancing solicitors’ failure to raise essential questions regarding the septic system, despite it being disclosed by the seller.
Based on the cost of remedying the issue, as well as the property’s diminished value, CEL Solicitors secured £25,000 for the client.
“Buying a home should be an exciting milestone, not a gateway to unexpected costs. Our priority was making sure Mark wasn’t left to deal with the financial burden of someone else’s oversight, and we were proud to secure a result that gave him the means to fix the issue and move forward with confidence.”
— Laurence Wright, Solicitor, CEL Solicitors
“CEL Solicitors have been excellent. We’re going into this summer with the most beautiful garden, for our friends, our family, and for us. I didn’t do anything to make that happen. I had a couple of conversations, and it was fixed. I’m in love with this forever house, and I’m so grateful.”
