Thank you for your enquiry with CEL Solicitors. Due to the information provided, we believe that on this occasion we are unable to continue with your claim.
You can find details on why we may decline a case below. We wish you the best of luck pursuing other avenues and hope that you will consider CEL Solicitors for any future legal or financial problems we may be able to assist you with.
Free Advice
We include below a free precedent complaint letter to the car dealership and car finance lender that will allow you to make a complaint yourself. If we have rejected your claim for low value we advise you to do this.
We wish you the best of luck in any complaint that you make, and we hope that you are refunded any commission.
Reasons for Rejection
We reject complaints for several reasons. These are set out below:
• The main reason is that we do not think we will be successful with your claim, either with the financial ombudsman or through the courts. We do not want to waste your time or get your hopes up by advising you that you have a good case when you do not.
• We also do not accept low-value claims where the total finance is under £10,000. The reason for this is that the claims are often not as complex, and you should be able to make a complaint yourself. It would not be cost-effective to carry out our in-depth investigations, draft complex complaint letters, complete a mis-selling report and/or issue court proceedings for low-value claims. The cost of this is more than you will recover.
• Other reasons may be that you were offered a discount by the car dealership or had a low rate of interest that would mean you were not mis-sold your finance.
• You are bankrupt so even if we are successful you will not get the money.
• You have already complained to the Financial Ombudsman and were rejected more than 2 weeks ago. You only have two weeks to appeal a decision.
• You bought your car too long ago for us to carry out any meaningful current investigations, records are only kept for 6 years.
Complaining Yourself
If you have a low-value claim, then we would advise you to complain to you the dealer and the lender provider using our precedent letters below. Complete your personal details and provide details of the mis-selling in your car deal. Then post or email it to the car dealer and lender complaint and/or Finance Team. They will have 8 weeks to respond. If they reject your claim or they do not respond after 8 weeks then you can complain to the Financial Ombudsman’s Service using the link below. Please remember to attach to your complaint letters any supporting evidence that you have, emails, funding agreements etc.
Further Advice
If you do make a complaint, then you have 6 months to complain to the Financial Ombudsman’s Service, if your claim is rejected by the dealership or lender.
You usually have 6 years in which to issue court proceedings from the date you signed your finance agreement or became aware that your finance agreement had been missed.
